Kentucky’s At-Will Rule & When It Doesn’t Apply

Kentucky is an at-will employment state. An employer can generally terminate an employee at any time, for any reason, or for no reason at all. But at-will employment has real limits, and understanding where those limits fall is what determines whether a termination was lawful.

Kentucky law, through the Kentucky Civil Rights Act (KRS Chapter 344), federal statutes, and common law, recognizes four primary exceptions that can give rise to a wrongful termination claim:
