How Kentucky’s Rideshare Insurance Rules Work

Kentucky classifies Uber and Lyft as Transportation Network Companies, or TNCs, under KRS 281.655. That classification determines which insurance policy applies to your injuries, and the answer depends entirely on what the driver was doing at the moment of the crash.

There are three distinct phases, each with different coverage:

App off: The driver’s personal auto policy applies. Standard personal auto policies typically exclude coverage once a driver is logged into a rideshare app or transporting passengers for a fee, so if coverage exists here at all, it’s limited.
App on, waiting for a request: Uber and Lyft provide some contingent coverage during this phase, but it’s lower than what applies once a ride begins.
En Route or Transporting a Passenger: Under Kentucky regulation 601 KAR 1:113, TNCs must maintain primary automobile liability insurance recognizing the driver as a TNC driver. Coverage requirements increase substantially during this phase and can reach up to $1,000,000 in primary liability.

Kentucky No-Fault Rules & Filing Deadlines

Kentucky operates under a no-fault motor vehicle insurance system. Your own personal injury protection (PIP) coverage pays your initial medical expenses and lost wages regardless of who caused the crash. Once those benefits are exhausted, or if your injuries meet the threshold to step outside the no-fault system, you can pursue a claim against the at-fault party.

Kentucky follows a comparative fault rule, so if you were partly responsible for the accident, your compensation is reduced by your percentage of fault. The filing deadline for motor vehicle injury claims in Kentucky is generally two years from the accident date, or from the date of the last PIP payment, whichever is later, under KRS 304.39-230. Driver Status, Company Liability, & Kentucky TNC Requirements

Uber and Lyft classify their drivers as independent contractors rather than employees. That distinction limits direct claims against the company itself in most situations, but it doesn’t eliminate them. Kentucky law requires TNCs to complete a criminal background check and a driving record review before approving a driver to accept rides. Vehicles must also pass an annual mechanical inspection and display the company’s decal or certificate while active.
